Can a Last-minute Trust Save My Assets in a Divorce??? Probably, if the assets are TRULY yours. But… it depends. I am Jim Daloisio, Director of Legal Services at Torchlight Tax.
The sooner it is set up, the better. Asset Protection Trusts of YOUR assets do not generally require spousal approval like post-nuptial agreements do. A proper asset protection trust in a proper jurisdiction can work even if created after marriage. This depends on the exact circumstances and your lawyer’s skill. If you have considerable assets, you should have an asset protection trust anyway.
